Terms of Service

Effective April 12, 2026

These Terms of Service ("Terms") govern your access to and use of Fwalla ("Fwalla," "we," "us"), a service operated as an individual developer project reachable at fwalla.com.

By signing in to Fwalla or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Accounts

You sign in to Fwalla using a Google account. You are responsible for maintaining the security of that Google account and for all activity that occurs under your Fwalla account. You must be at least 13 years old and legally able to enter into this agreement.

2. Permitted use

Fwalla is a tool for composing and sending personalized outbound email from a Gmail mailbox you own or are authorized to use. You agree to use the Service only for lawful purposes and only to contact individuals who have a reasonable expectation of hearing from you (e.g., recruiters at companies you are actively pursuing).

3. Prohibited use

You must not use Fwalla to:

• Send unsolicited bulk email (spam), commercial solicitation to purchased lists, or any message that violates the U.S. CAN-SPAM Act, Canada's CASL, the EU ePrivacy Directive, or any other applicable anti-spam law.
• Send messages containing malware, phishing content, harassment, hate speech, illegal content, or deceptive material.
• Impersonate any person or entity, or misrepresent the sending mailbox.
• Attempt to circumvent the Service's sending limits, rate limits, or safety controls.
• Attempt to access data or accounts that do not belong to you, probe or scan the Service for vulnerabilities without authorization, or interfere with the Service's operation.
• Resell, sublicense, or operate the Service on behalf of third parties without written permission.

You are solely responsible for the content of messages you send through Fwalla and for compliance with all applicable laws, including CAN-SPAM, CASL, GDPR, and the Gmail bulk sender guidelines.

4. Connected Gmail mailboxes

When you connect a Gmail mailbox, you authorize Fwalla to compose and send email on your behalf from that mailbox, subject to the gmail.compose scope. Fwalla does not read your inbox, sent folder, labels, or other mailbox contents. You can revoke Fwalla's access at any time by disconnecting the mailbox in the Service or by visiting myaccount.google.com/permissions.

5. Fees

Fwalla is currently provided free of charge. We may introduce paid tiers in the future. If we do, we will notify existing users before their continued use becomes subject to any fee.

6. Service availability

Fwalla is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or that any scheduled message will be delivered at an exact moment. Delivery depends on Gmail's availability and the recipient's mail server.

7. Suspension and termination

We may suspend or terminate your access to the Service at any time, without notice, if we reasonably believe you have violated these Terms, threatened the security or reputation of the Service, or exposed Fwalla to legal risk. You may terminate your account at any time by emailing support@fwalla.com.

8. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, FWALLA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOU USE THE SERVICE AT YOUR OWN RISK.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FWALLA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOST GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF FWALLA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FWALLA'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).

10. Indemnification

You agree to indemnify and hold harmless Fwalla and its operator from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of your use of the Service, messages you send through the Service, or your violation of these Terms or applicable law.

11. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-laws rules. Any dispute arising from these Terms or your use of the Service will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email and/or in-app notice before the change takes effect. Continued use of the Service after the change takes effect constitutes acceptance of the updated Terms.
